$1.82 Million Awarded in Employment Lawsuit


This is a settlement for the Employment lawsuit.

A 20-year veteran sales manager was fired from his job at South Jersey Industries in 2005, based on a report that his work performance was poor. Scott Jones subsequently sued his former employer, for failure to accommodate, alleging that he was depressed at the time.

Jones had started seeing a company psychologist for depression; however, he was not referred on for medical attention. Jones' supervisor terminated him for poor performance, without having consulted the psychologist. Later, Jones received a diagnosis of clinical depression. In the lawsuit, Jones' former employer argued that Jones had not requested accommodation for his depression, and that he had never been a top performer. Jones denied this.

Jones was awarded $720,544 for lost earnings, $750,000 for punitive damages and $350,000 for pain and suffering.
