$4M Settlement Reached in Toys R Us Employment Class Action Lawsuit
This is a settlement for the Donning-Doffing lawsuit.
New York, NY: A $4 million settlement has been reached in a wage and hour class action lawsuit pending against three Toys R Us Inc stores in California.
The class action lawsuit was filed in California federal court and represents some 39,000 current and former employees, who allege the retailer is in violation of California labor laws. Specifically, the lawsuit claims the retailer violated state laws regarding meals, breaks, overtime and minimum-wages.
Two separate putative class actions filed in 2013, by plaintiffs Zia Hicks and Nicole Grana, former and current employees of Toys R Us and Babies R Us, respectively, were subsequently consolidated into this class action. The case is Zia Hicks, et al. and Nicolette Grana, et al. v. Toys 'R' Us-Delaware Inc., et al., case number cv13-1302-dsf, in the U.S. District Court for the Central District of California.)
The settlement terms provide for monetary relief and demand that Toys R US make changes to its policies including education of managers and supervisors about the requirements for authorizing and permitting meal periods and rest breaks to comply with revised company procedures and California law. Changes to paystubs that more clearly illustrate payment of meal periods and rest breaks were also part of the settlement terms. Additionally, Toys R Us amended its security inspection procedures so that they are now conducted on the clock.
According to the settlement motion, the average compensation per class member is about $70, but "this average net recovery is comparable to other wage and hour class action settlements approved by California state and federal courts."The settlement agreement resulted from two days of mediation.
