Mr. Brooks was hired by the defendant as an able-bodied seaman with a pre-existing lower back herniated disc compressing the nerve roots. Brooks was tasked with removing tile and grout from a restroom on-board the ship, which caused an aggravation of his pre-existing disc injury. The aggravation manifested itself as cramping and pain in his calf. The suit alleged that this task, along with other unassisted heavy lifting further aggravated his pre-existing back injury. The case settled the week of trial for $1,475,000.
