$1.5M Tentative Settlement Reached in Restoration Hardware Wage and Hour Class Action Lawsuit

Santa Clara, CA: Preliminary approval has been granted to a proposed $1.5 million settlement of a wage and hour
class action filed on behalf of 2,200 Restoration Hardware employees who alleged the retailer failed to provide meal and rest breaks, in violation of the California labor law.
Specifically, the class action alleged the California-based company failed to pay overtime wages for all hours worked, provide meal and rest breaks, and reimburse workers for all business expenses, among other violations.
According to the terms of the agreement, the class settlement amount of $1.5 million will be used for individual settlement payments, enhanced payments to class representatives, settlement administration costs and attorneys' fees and costs.
Los Angeles Superior Court Judge William F. Highberger signed off an order granting tentative approval of the class action settlement during Tuesday' brief hearing and set an April 12 date for final approval. The two named plaintiffs, who originally filed separate class actions, will each receive $10,000 in addition to their settlement payments. An additional two named plaintiffs will also receive an enhancement of $5,000 each, for their role in the suit.
Class members, estimated to number around 2,200, include all current and former employees at any of Restoration Hardware's California retail and outlet stores in nonexempt positions between June 4, 2009, to the date of the settlement.
The case is Restoration Hardware Wage and Hour Cases, case number JCCP4794, in the Superior Court of the State of California for the County of Los Angeles.
