$900K Settlement Final in Thrifty Payless Unpaid Overtime Class Action Lawsuit

This is a settlement for the Employment lawsuit.

Santa Clara, CA: A $900,000 settlement of an unpaid wages and overtime class action lawsuit pending against Thrifty Payless Inc, has received final approval. The lawsuit will resolve claims brought by 7,400 current and former employees of the drugstore chain.

The complaint was filed by Oscar Willis Jr. and Renee Ortiz who alleged that Thrifty Payless failed to reimburse them for business-related expenses, such as travel from one store to another or making trips to the bank using their own vehicles. The suit also claimed the defendant failed to provide meal breaks to non-exempt managers.

Ortiz remains the main lead plaintiff as Willis moved to be dismissed from the instant case since his claims are folded into a settlement alleging similar claims against Rite Aid who bought Thrifty Payless in 1996.

According to the suit, Ortiz worked for Thrifty PayLess and, later, Rite Aid, from July 1989 through November 2011. Ortiz will receive an incentive award in excess of $5,000.

The case is Oscar Willis Jr., et al. v. Thrifty Payless Inc., case number BC494909 in the Superior Court of the State of California, County of Los Angeles.

I've been working for rite aid for 4 years now and I didn't receive anything at all. But some people who only worked for the company for only months got one? I'm confused who actually gets a check and who doesn't?

I need a reissue of the settlement check. It was accidentally thrown away.
